SB 507 TO PASS HOUSE-- CALL YOUR SENATOR TODAY

We have information that indicates that SB 507 will likely pass the house today and then be heard in the senate for an up or down vote on Monday.  It is imperative we have as many calls and e-mails to senators urging them to vote against this terrible piece of legislation.

Only one thing trumps the kind of money that companies like Chesapeake, and Devon Energy and PLICO have, and that is regular and consistent exposure to the truth by CONSTITUENTS.

* SB 507 discriminates against women, children, and elderly by imposing caps on noneconomic damages of $300,000.  .  Data shows that those that would be harmed by these kinds of provisions are those who are the most severely injured, those who are left blind, paralyzed, or brain damaged.  Although the bill allows the caps to be lifted, this would happen only in the rarest of cases when a jury, in a separate proceeding, found by clear and convincing evidence that the Defendant was grossly negligent or acted intentionally AND the Judge finds beyond a reasonable doubt that the Defendant acted intentionally;

* SB 507 makes unwarranted changes in the Oklahoma Evidence Code by abolishing the collateral source rule AND requiring the jury to make a deduction from the Plaintiff’s damages;

*SB 507 eliminates Joint and Several liability thereby balancing the burden of an uninsured or underinsured Defendant on the back of the fault-free victim;

* SB 507 limits appellate bonds without consideration to the size of the verdict or the Defendant;

*SB 507 would be harmful for many Oklahomans as it contains a broad statute of repose of eight years-- it would not allow someone who purchased a product that is older than 8 years to recover for a product that was defective, even if the manufacturer knew it was not safe. The limitation of liability would include things like farm equipment and used cars, thus decreasing the incentives for manufacturers to make products that are safe and provides immunity if they can get past the 8 year mark.

With the senate evenly divided, it is critical you contact your senator today to encourage them to vote against this terrible piece of legislation.
